The
Contract
All contracts for the sale of goods made through the Global
Academic Press webshop are made between you, as the customer, and
ProefschriftMaken BV, De Limiet 26, 4131 NR Vianen, The Netherlands
(hereinafter 'ProefschriftMaken BV'), as the supplier of goods on behalf of Global
Academic Press.
ProefschriftMaken BV must receive payment of the whole of the price for the
goods that you order before your order can be accepted, and the contract
formed. Once payment has been received ProefschriftMaken BV will confirm that
your order has been received by sending you an email at the email address you
have provided. The email will include your name, the order number and the total
price. ProefschriftMaken BV’s acceptance of your order brings into existence a
legally binding contract.
ProefschriftMaken BV is entitled to withdraw from any contract in the case of
obvious errors or inaccuracies regarding the goods appearing on the Global
Academic Press website. If an error or inaccuracy is discovered with regards to
the advertised price of the goods that you have ordered, ProefschriftMaken BV
will contact you as soon as possible by email. This will be to inform you of
the correct price of the goods, and to ask you if you wish to continue with the
order at the amended price or cancel the order.
Availability of
goods
If there is insufficient stock to deliver some or all
of the goods you have ordered, ProefschriftMaken BV will notify you as soon as
possible of which parts of your order that will be accepted and those that will
be rejected. Any sums paid by you for goods not supplied to you will be
re-credited to your account and ProefschriftMaken BV will let you know by email
which orders have been satisfied and which have been rejected. Any refund owed
to you will be made as soon as possible. ProefschriftMaken BV will not be
obliged to offer any additional compensation, for example, for disappointment suffered.
Postage &
Packaging
Postage and packing is charged in addition to the
charge for the goods. The cost of postage and packing depends on the region the
goods are is delivered to. The prices for postage and packing appear on the Global
Academic Press webshop and when you make your order, you accept them.
Delivery of
Goods
ProefschriftMaken BV endeavours to dispatch your order
within three days of receipt of the order. If the goods you ordered are out of
stock, or if there is postal disruption, ProefschriftMaken BV will get in touch
with you when your order is received and inform you of the best delivery
schedule. If that schedule is not acceptable to you, you may choose to cancel
your order.
ProefschriftMaken BV will post, or arrange a courier, to send the goods to the
person and address you provided when you made your order. For goods delivered
outside of the EU, the person to whom the consignment is sent (consignee) will
be regarded as the declarant and importer into the country to which the order
is sent. The consignee will be responsible for both customs clearance and
payment of any customs duties and local taxes where required. It is accepted by
you that ProefschriftMaken BV has no control over additional charges in
relation to customs clearance. Please check with your local customs officials
or post office for more information regarding importation taxes/duties that may
be applicable to your order.
You will become the owner of the goods you have ordered when the goods are
dispatched to you.
Returns
policy
If for any reason you are not happy with your
purchases, you may cancel your order within 14 days of receiving the goods. You
do not need to give any reason and will not have to pay any penalty.
You simply need to notify ProefschriftMaken BV that you are cancelling your
order and send the goods back to the return address noted on the delivery label
as soon as possible. When you return the goods please include your full name
and contact details and retain proof of posting. The cost of returning the
goods will be borne by you.
Once ProefschriftMaken BV has received the goods, provided they are in good
condition, the amount you have paid for the goods will be re-credited to your
account.
Replacement of
faulty or damaged goods
If the goods are damaged when you receive them, you
should let ProefschriftMaken BV know within 14 working days of delivery. You
should then return them to ProefschriftMaken BV and ProefschriftMaken BV will
replace them at no cost to you.
Liability
If the goods delivered are not what you ordered or are
damaged or defective or the delivery is of an incorrect quantity,
ProefschriftMaken BV shall have no liability to you unless you notify
ProefschriftMaken BV of the problem, in writing within 14 working days of the
delivery of the goods.
If you do not receive goods ordered by you within 30 days of the date on which
they were despatched, ProefschriftMaken BV shall have no liability to you
unless you notify ProefschriftMaken BV in writing within 40 days of the date on
which the goods were dispatched.
If you notify a problem to ProefschriftMaken BV, ProefschriftMaken BV may, at
its discretion, agree to make good any shortage or non-delivery; to replace or
repair any goods that are damaged or defective; or to refund to you the amount
paid by you for the goods. However, ProefschriftMaken BV not be liable to you
for any indirect or consequential loss or damage arising out of any problem you
notify to us and shall have no liability to pay any money to you by way of
compensation other than to refund to you the amount paid by you for the goods.
Note however, these conditions do not limit any rights you might have as a
consumer under applicable local law. Nor do they exclude or limit our liability
to you for any death or personal injury resulting from our negligence.
Nothing in this contract creates any right which is enforceable by or in
relation to any person who is not a party to the contract. For the avoidance of
doubt, Global Academic Press shall have no additional liability towards you,
once any liability assumed by ProefschriftMaken BV has been paid.
Force Majeure
ProefschriftMaken BV shall have no liability to you
for any failure to deliver goods you have ordered or any delay in doing so or
for any damage or defect to goods delivered that is caused by any event or
circumstance beyond its reasonable control.
Invalidity
If any part of these conditions is unenforceable
(including any provision in which ProefschriftMaken BV excludes its liability
to you) the enforceability of any other part of these conditions will not be
affected.
Complaints
If you have a complaint, please contact
ProefschriftMaken BV at the contact address on the Global Academic Press
webshop. In order to investigate your complaint, please ensure that it is
described clearly. No complaint whose meaning is unclear will be investigated.
Governing Law
The contract between you and ProefschriftMaken BV
shall be governed by and interpreted in accordance with Dutch law, and the
Dutch courts shall have jurisdiction to resolve any disputes between you and
ProefschriftMaken BV.
Entire Agreement
These terms and conditions, together with the current
webshop prices, delivery details and ProefschriftMaken BV contact details, set
out the whole of our agreement relating to the supply of the goods to you by
ProefschriftMaken BV. They may only be varied by ProefschriftMaken BV.
Webshop
The nature of Internet communications means that your
communications may be susceptible to data corruption, interception and delays.
Neither ProefschriftMaken BV nor Global Academic Press shall be responsible for
any detrimental reliance you place on the Global Academic Press webshop or its
contents.
In addition, ProefschriftMaken BV makes no representations or warranties about
the accuracy, completeness or suitability for any particular purpose of the
information on the Global Academic Press webshop or that it is free of viruses
or other harmful components.
The information contained on the site may contain technical inaccuracies or
typographical errors. All liability of ProefschriftMaken BV for any such
inaccuracies or errors is excluded to the fullest extent permitted by
applicable law.
ProefschriftMaken BV shall not be liable for damages of any kind arising in
connection with the use of the Global Academic Press webshop.
The Global Academic Press webshop may contain links to sites of other
organisations, which are not within its control. Global Academic Press and
ProefschriftMaken BV have no responsibility any information you can access via
other websites.
